Frequently asked questions about technical documentation in Mallorca

We answer the most common questions about energy certificates, habitation certificates, plans and inspections of properties in Mallorca.

When do I need an energy certificate?

An energy certificate is required before advertising, selling or renting a home or premises. The energy rating must be shown while the property is being marketed, so it is best not to wait until the moment of signing.

Can I be penalised for advertising a property without an energy certificate?

Yes. Advertising a home or premises without including the corresponding energy information may lead to penalties. We recommend obtaining the certificate before listing the property.

How long does an energy certificate take?

Under normal conditions, an energy certificate is usually ready in approximately one calendar week from the visit and receipt of the required documents. In urgent cases, faster processing can be assessed.

How long is an energy certificate valid for?

The general maximum validity is 10 years, except when the rating is G, in which case the maximum validity is 5 years. Renewal requires technical work similar to that of a new certificate.

Can I produce the energy certificate myself?

No. The certificate must be produced and signed by a competent technician, such as a qualified engineer or architect.

When do I need a habitation certificate?

The habitation certificate may be required for sales, rentals, connection or changes of utility supplies and the documentary review of homes. In practice it is requested in most transactions, especially if the buyer needs bank financing.

Why is the habitation certificate important for a foreign buyer?

Because it provides reassurance that the home was built with the proper permits and meets the legally required habitability conditions. It is not only a documentary matter: it can be relevant to buyers, banks, lawyers and estate agencies during the sale.

How long does a habitation certificate take?

It depends on the administrative processing once submitted. That timeframe does not depend on our practice, but on the workload of the Conselleria's staff. It is usually around two to four weeks, although it may vary depending on the time of year and the specific case.

What documentation do I need?

As a minimum, we recommend providing a copy of the nota simple or title deed and a copy of the owner's NIF, NIE or identification document. For the habitation certificate, if one exists, the previous certificate should be provided. If it is not available, a full electricity invoice for the property may be required; a bank receipt alone is not sufficient.

Do you prepare property plans?

Yes. We prepare plans and measurements for renovations, projects, sales, commercial presentation or to help understand the layout of a home.

Do you carry out inspections before buying or receiving a home?

Yes. We can carry out a prior visual review to detect visible defects, finishing problems, damp, cracks or damage. The documentation provided is usually graphic, with photographs or videos of the issues found.

Are the documents delivered on paper?

Not usually. Since procedures became digital, documents are normally delivered in digital format, electronically signed by qualified technicians.
